Due to the residency restrictions mentioned above, the vast majority of American couples choose to complete the legal procedure quickly and easily in their home county in the U.S. or obtain a marriage license in their state.

Once the legal bond has been established in the United States, they move the actual celebration to Spain.   • Official birth certificate: Issued by the civil registry of the state of birth. It must be a certified long-form copy.
  • Proof of residence : If you live in Spain, the Certificate of residence registration for the last two years is required, requested from the Town Hall where you reside. If you live in the U.S., it may be justified through tax returns, utility bills in your name, or your voter history.
  • Certificate of civil status: An official document proving whether you are single, divorced, or widowed. Since this document does not exist as such at the federal level in the U.S., it is resolved through a sworn statement at the U.S. Consulate in Spain, known as proof of freedom to marry.
  • Divorce decree or death certificate, if applicable: If either partner has been formally married before, they must present the previous marriage certificate together with the final divorce decree or the death certificate of the former spouse.

The Certificate of No Impediment and the role of the U.S. Embassy

Spain requests a Certificate of No Impediment, a document commonly used in European countries that certifies there are no legal obstacles preventing a person from getting married.

Once the authorized civil or religious wedding has taken place in Spain, the marriage is formalized in Spanish territory, but one final step is required to ensure its international recognition and legal protection.

The wedding officiant or the religious venue itself will provide the newlyweds with a certification of the marriage. This document must be submitted to the corresponding Civil Registry in order to obtain the Spanish Family Book and the Literal Marriage Certificate.

As a general rule, any legal marriage celebrated abroad that is valid under the laws of that country is fully recognized as legal in the United States. There is neither an obligation nor a possibility to “register” a foreign marriage with the U.S. federal government.

However, to carry out administrative procedures in the U.S., such as changing your surname on your passport, shared health insurance coverage, or joint tax filings, you will need to present your Spanish Literal Marriage Certificate.
